This contract is an agreement between the Photographer, Kat Sara Frost of Kat Sara Portraits and the Client:

I agree to the following Terms for my contracted work as a model for Kat Sara Portraits. 1. Scope of Work: This contract is for services related to your photoshoot with Kat Sara Frost of Kat Sara Portraits. You, as the Client, agree that you are modelling for Kat Sara Portraits for a photoshoot and your renumeration shall be six edited digital photographs from the shoot, which you can select from the entire galllery of images. You will also receive the benefit 50% off upgrades if you’d like more than six images from the photoshoot. Photographer and Client are to arrive for the shoot at your scheduled time. Kat Sara Portraits retains the right to basic post processing or digital image editing services on these photographs where artistically necessary. 2.Work Product: All photos delivered to Client are licensed for Client’s personal use only. 3. Indemnification: Photographer and Client agree that Photographer is in no obligation to capture any specific moment or pose or person(s) during the shoot. Kat Sara Portraits retains the right to cancel or reschedule for reasons out of their control, for example: bad weather, traffic conditions, location conditions, illness etc. Client agrees that photographer is not liable for any damage or loss related to technological failure including data loss. Client understands and agrees that Photographer is not required to maintain copies of the photos from this shoot more than sixty days after the photos have been delivered to the client. Client agrees that Photographer is not liable for any personal injury that may occur on the photoshoot. Client agrees that they will check themselves and their party over for ticks after outdoor photoshoots and should anyone be bitten by a tick, Photographer is not liable. Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of Client. Client agrees that they may be held liable for any damages caused by them or their party to any equipment or props owned by Photographer. 4. Duty of Client: Client will agree to keep all photographic devices of their own in their bag during the photoshoot, including mobile phones, unless specifically asked by Photographer to capture some ‘behind the scenes’ imagery. Client agrees to protect the land we use during the photoshoot. Client agrees to write a short positive review for Kat Sara Portraits to be used in Kat Sara Portraits’s marketing material. 5. Exclusive Photographer: Client agrees and understands that no other party other than the Photographer may take pictures of the set ups made by the Photographer. Client also agrees not to use their session time to create any set ups of their own kind as this slows the photographer’s work. 6. Model Release: Client grants permission to Kat Sara Frost and their assigns, licensees, and legal representatives the irrevocable right to use my name, likeness, and image in all forms and media for commercial, advertising, trade, or any other lawful purposes, worldwide and in perpetuity. 7. Copyright: Kat Sara Portraits retains all copyright for the images produced. Kat Sara Portraits allows Client a license to use and print the images for their own personal use only. Client must not sell or share images for any marketing purposes including newspapers, brands, companies or anyone else who may profit from the images produced.
