Kat Sara Frost

This contract is an agreement between the Photographer: Wild Frost Photography and the Client:

1. Scope of Work: This contract is for services and products related to your photoshoot with Wild Frost Photography. Photographer and Client are to arrive for the shoot at your scheduled time. Wild Frost Photography retains the right to basic post processing or digital image editing services on these photographs where artistically necessary.
2. Work Product: Wild Frost Photography will provide a link to download all edited images from the shoot for the Client no later than eight weeks after the date of the photoshoot. All photos delivered to Client are licensed for Client’s personal use only.
3. Indemnification: 4.1: Photographer and Client agree that Photographer is in no obligation to capture any specific moment or pose or person(s) during the shoot. 4.2: Wild Frost Photography retains the right to cancel or reschedule for reasons out of their control, for example: bad weather, traffic conditions, location conditions, illness. 4.3: Client agrees that Photographer is not liable for any damage or loss related to technological failure including data loss. 4.4: Client understands and agrees that Photographer is not required to maintain copies of the photos from this shoot more than sixty days after the photos have been delivered to the client. 4.5: Client agrees that Photographer is not liable for any personal injury that may occur on the photoshoot. Client agrees that they will check themselves and their party over for ticks after outdoor photoshoots and should anyone be bitten by a tick, Photographer is not liable. 4.6: Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of Client. 4.7: Client agrees that they may be held liable for any damages caused by them or their party to any equipment or props owned by Photographer.
4. Duty of Client: Client agrees to protect the land we use during the photoshoot.
5. Exclusive Photographer: Client agrees and understands that no other party other than the Photographer may take pictures of the set ups made by the Photographer, with the exception of Photographer asking Client to take some ‘behind the scenes’ imagery which Photographer may use for promotion. Client also agrees not to use their session time to create any set ups of their own kind as this slows the photographer’s work.
6. Copyright: Wild Frost Photography retains all copyright for the images produced. Upon purchasing a package, Wild Frost Photographer allows Client a license to use and print the images for their own personal use only. Client may post any images they have bought on their social media pages, and agrees not to apply any edits or filters when doing so. It is not a requirement to credit Photographer’s work once images are purchased, but tagging Wid Frost Photography would be much appreciated if possible. Client agrees not to screenshot images from Kat Sara Creative social media pages or online gallery. Client must not sell or share images for any marketing purposes including newspapers, brands, companies or anyone else who may profit from the images produced.
7. Model Release: I would love to be able to show off the art we create by including it in my portfolio. Please let me know by ticking the boxes how I may use the images from your Photoshoot.
