Kat Sara Frost

This contract is an agreement between the Photographer: Kat Sara Frost and the Client:

1. Scope of Work: This contract is for services and products related to your photoshoot with Kat Sara Portraits. Photographer and Client are to arrive for the shoot at your scheduled time. Photographer retains the right to basic post processing or digital image editing services on these photographs where artistically necessary.
2. Fees: In consideration for the photography services provided by the Photographer, Client agrees to pay the non-refundable session fee which is the sum of £195 (including the January Discount). A £29 deposit payment reserves the Photographer‘s time. Photographer agrees not to advertise this slot to any other potential clients. If the Client cancels this shoot for any reason, the initial payment will not be returned. Instead, Photographer will offer an alternative date. The £166 balance is due on the day of the shoot via bank transfer or cash
3. Work Product: Photographer will provide an online watermarked gallery for Client to choose their favourite images from the photoshoot. The £195 session fee includes 6 images and once selected, Photographer will authorise their download by Client. If Client wishes to purchase more images from the gallery, they can make payment via bank transfer and once received, Photographer will authorise the images to be downloaded. The online gallery is only provided once the session fee has been paid in full. No photographs will be delivered without payment. All photos delivered to Client are licensed for Client’s personal use only.
4. Indemnification: 4.1: Photographer and Client agree that Photographer is in no obligation to capture any specific moment or pose or person(s) during the shoot. 4.2: Photographer retains the right to cancel or reschedule for reasons out of their control, for example: bad weather, traffic conditions, location conditions, illness. Photographer will return in full all payments made by Client to Photographer in relation to this shoot under these circumstances only if another date cannot be arranged. 4.3: Client agrees that Photographer is not liable for any damage or loss related to technological failure including data loss. 4.4: Client understands and agrees that Photographer is not required to maintain copies of the photos from this shoot more than thirty days after the photos have been delivered to the client. 4.5: Client agrees that Photographer is not liable for any personal injury that may occur on the photoshoot. Client agrees that they will check themselves and their party over for ticks after outdoor photoshoots and should anyone be bitten by a tick, Photographer is not liable. 4.6: Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of Client. 4.7: Client agrees that they may be held liable for any damages caused by them or their party to any equipment or props owned by Photographer.
5. Duty of Client: Client will agree not to take any photographs or video of their own during the session, unless asked to by Photographer, ie for some ‘behind the scenes’ footage. Client agrees to protect the land we use during the photoshoot.
6. Exclusive Photographer: Client agrees and understands that no other party other than the Photographer may take pictures of the set ups made by the Photographer, with the exception of Photographer asking Client to take some ‘behind the scenes’ imagery which Photographer may use for promotion. Client also agrees not to use their session time to create any set ups of their own kind as this slows the photographer’s work.
7. Copyright: Katherine Sara Frost retains all copyright for the images produced. Upon purchasing images, Photographer allows Client a license to use and print the images for their own personal use only. Client may post any images they have bought on their social media pages, and agrees not to apply any edits or filters when doing so. It is not a requirement to credit Photographer’s work once images are purchased, but tagging Kat Sara Portraits would be much appreciated if possible. Client agrees not to screenshot images from Kat Sara Creative social media pages or online gallery. Client must not sell or share images for any marketing purposes including newspapers, brands, companies or anyone else who may profit from the images produced.
