Kat Sara Frost

This contract is an agreement between the Photographer: Kat Sara Creative and the Client:

1. Scope of Work: This contract is for services and products related to your photoshoot with Kat Sara Creative. Photographer and Client are to arrive for the shoot at your scheduled time. Kat Sara Creative retains the right to basic post processing or digital image editing services on these photographs where artistically necessary.
2. Fees: In consideration for the photography services provided by the Photographer, Client agrees to pay the session fee which is the sum of £40 per session (Maternity and Newborn). Client agrees to pay these sums to Kat Sara Frost of Kat Sara Creative as non-refundable initial payments. The initial payments reserve the Photographer‘s time. Kat Sara Creative agrees not to advertise the slots to any other potential clients. If the Client cancels either of these shoots for any reason, the respective initial payment will not be returned. Instead, Photographer will offer an alternative date. If continued cancellations occur, Kat Sara Creative retains the right to charge the initial payment again to reserve a new date. The balance fee for the photoshoot is due on the day of the shoot.
3. Work Product: Kat Sara Creative will provide the Client with at least 40 edited photographs no later than four weeks after the date of the photoshoot. Photos will only be delivered once the balance has been paid for the shoot. You can choose to pay for the entire Bump to Baby Package (£325, minus £40 session fee for maternity shoot = £285) or, only the maternity shoot half of the final balance plus session fee for the newborn shoot (162.50 minus £40 maternity session fee already paid, plus £40 to reserve newborn shoot fee = £162.50). A further £122.50 will be due on the day of the Newborn shoot to reach the full balance. Photos are only included when the session fee has been paid in full, on the day of your photoshoot. For the Bump to Baby Package, you will receive all edited photographs from the Maternity shoot (40 plus) even if you have only paid the Maternity half of the package, plus booking fee for the newborn shoot. No photographs will be delivered without payment. All photos delivered to Client are licensed for Client’s personal use only.
4. Indemnification: 4.1: Photographer and Client agree that Photographer is in no obligation to capture any specific moment or pose or person(s) during the shoot. 4.2: Kat Sara Creative retains the right to cancel or reschedule for reasons out of their control, for example: bad weather, traffic conditions, location conditions, illness. Photographer will return in full all payments made by Client to Photographer in relation to this shoot under these circumstances only if another date cannot be arranged. 4.3: Client agrees that photographer is not liable for any damage or loss related to technological failure including data loss. 4.4: Client understands and agrees that Photographer is not required to maintain copies of the photos from this shoot more than sixty days after the photos have been delivered to the client. 4.5: Client agrees that Photographer is not liable for any personal injury that may occur on the photoshoot. Client agrees that they will check themselves and their party over for ticks after outdoor photoshoots and should anyone be bitten by a tick, Photographer is not liable. 4.6: Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of Client. 4.7: Client agrees that they may be held liable for any damages caused by them or their party to any equipment or props owned by Photographer.
5. Duty of Client: Client will agree to keep all photographic devices of their own in their bag during the photoshoot, including mobile phones. Client agrees to protect the land we use during the photoshoot.
6. Exclusive Photographer: Client agrees and understands that no other party other than the Photographer may take pictures of the set ups made by the Photographer. Client also agrees not to use their session time to create any set ups of their own kind as this slows the photographer’s work.
7. Model Release: Please use the opt in box to agree to this term.Client grants permission to Photographer to use Client’s image, or likeness any and all forms of media for commercial purposes, advertising, trade, personal use, ore any and all other uses, including website use, social media and marketing material.
8. Copyright: Kat Sara Creative retains all copyright for the images produced. Upon purchasing a package, Kat Sara Creative allows Client a license to use and print the images for their own personal use only. Client agrees not to screenshot images from Kat Sara Creative social media pages or online gallery. This will be deemed as stealing. Client must not sell or share images for any marketing purposes including newspapers, brands, companies or anyone else who may profit from the images produced.
